The Lawful Use of Deadly Force has changed to higher “necessary” standard

Utah House Bill 369 which was sponsored by a Utah Republican has changed Utah Defense of Habitation law that moves us from a reasonable standard of self-defense to a much higher “necessary” standard in using deadly force when defending their habitation, real property, their places of business, employment and their occupied vehicles now. This new stricter use of deadly force only applies to private persons, peace officer’s are unaffected by this law under 76-2-404 House bill 369 also, conflicts with House Bill 84, in that is also restricts this use of deadly force used by Armed Teachers, School Guardians and Armed Security Officers that our legislature is tasking them with stepping up and protecting in our schools.
